General conditions of use of the BOAD website

All connections to the BOAD website are subject to compliance with these terms and conditions. For the Internet user (hereinafter referred to as the "User"), mere access to the BOAD website implies acceptance of all the conditions described below and a commitment to respect them. If the User does not wish to be bound by these general conditions of use, he/she may not use the website. These terms and conditions of use may be modified at any time by BOAD.

Presentation of the BOAD website

 

The purpose of the BOAD website is to provide general information on BOAD’s activities.

In addition to presenting BOAD, the website also includes information on (i) BOAD’s areas of intervention, (ii) financing, (iii) news, (iv) opportunities for calls for tenders, expressions of interest or recruitment, as well as (v) access to certain BOAD strategic documents and annual reports.

 

Services

 

The BOAD website offers job offers, invitations to tender and calls for expressions of interest for any candidate, project owner, prospect or beneficiary who would like to take up a position with BOAD or receive BOAD financing for a project in line with BOAD’s missions.

The site also offers users the possibility of denouncing reprehensible practices via a contact form on the home page.

 

Liability

 

BOAD cannot be held responsible for technical problems encountered on the site.

The existence of a link on the BOAD website to another website does not constitute an endorsement of that site or its content by BOAD.

BOAD cannot be held responsible for problems encountered on any other sites to which links are established, or for any other information published on these sites, nor for the consequences of their use.

 

Intellectual property

 

BOAD’s banners, corporate names and graphic charters posted on the BOAD website may not be reproduced, distributed, resold, retransmitted or made available to third parties on a website or on any other type of medium or by any process whatsoever without the prior express authorization of BOAD.

In all cases, BOAD retains all intellectual property rights relating to all the elements indicated in this article. BOAD reserves the right, at any time, without notice and without having to justify its decision, to prohibit any person concerned from using its elements. In this case, the persons concerned will have a period of 8 working days to put an end to the practices infringing BOAD’s intellectual property rights.

Failure to comply with these obligations constitutes counterfeiting, for which the counterfeiter may be held civilly and criminally liable.

BOAD authorizes any website to establish a link pointing to the address https://www.boad.org/ after prior notification to the Publishing Director.

Any such link must comply with the legal and regulatory provisions in force. BOAD cannot be held responsible for links established from another site to the BOAD website.

BOAD reserves the right to prohibit such links at any time, without notice and without having to change its decision. In this case, BOAD will inform the person concerned, who will have 2 working days to terminate the link.

 

Integrity of these general conditions of use

 

Should one or more of the clauses of the present terms and conditions be declared null and void in application of a law, regulation or following a final decision rendered by a competent court, the other clauses of the terms and conditions will retain their binding force to the extent of the said decision.

 

Applicable law and disputes

 

The present general conditions of use are governed by Togolese law.

If an amicable solution cannot be found within a reasonable period of time, any disputes arising from the use of the BOAD website or from the interpretation of these general conditions of use shall be submitted to the competent courts.
